The Commencement Date and the Commencement of Works date means in essence the same date.
The Agreement only comes into effect on the day when the Contractor receives an original copy of the signed contract document.
The Contractor has 5 working days to raise any objection on the contents of the signed contract document once provided with the original copy of the document.
The Due Completion Date is calculated from the date the Contractor may commence with the Works.
A Letter of Acceptance substitutes the requirement by the Employer to sign the Contract document’s Form of Acceptance.
The Schedule of Deviations page may be completed by the Tenderer at tender stage to list deviations to the tender submitted.
A tenderer’s covering letter to a submitted tender may substitute the Schedule of Deviations and can just be bound into and signed into the Contract.
The Contract Data must list all the documentation that must be delivered before Commencement of Works may occur.
The Employer’s Agent may allow the Commencement of Works without the provision of the documentation listed in the Contract.
In the event that the Employer’s Agent fail to respond to the documentation delivered by the Contractor, then the documentation submitted is deemed rejected.
